Welcome to Chickadee Health. These Terms & Conditions ("Terms") govern your use of our health monitoring mobile application and related services. By using Chickadee Health, you agree to these Terms. Please read them carefully.

Service Description

Chickadee Health is a health monitoring service that:

  • Analyzes health data from Apple HealthKit to identify patterns that may indicate fall risks or health concerns
  • Sends SMS text message alerts to your designated family members when concerning patterns are detected
  • Helps families stay connected and provide timely support for aging loved ones
  • Provides health insights and trends within our mobile application

Chickadee Health creates a family health monitoring network where you choose who receives alerts about your health patterns.

SMS Messaging Terms

By using Chickadee Health and providing phone numbers for health alerts, you agree to the following SMS terms:

Message Frequency

  • Message frequency may vary. You or your family members may receive SMS alerts when concerning health patterns are detected.
  • The number of messages depends on health monitoring activity and is not predetermined
  • Alerts are sent only when our system identifies patterns that warrant family notification

Costs and Charges

  • Message and data rates may apply based on your mobile carrier's plan
  • Chickadee Health does not charge for SMS messages, but your carrier may
  • Check with your mobile service provider for details about your messaging plan

Opting Out

  • You can opt out at any time by replying STOP to any SMS message from Chickadee Health
  • After replying STOP, you will receive one final confirmation message
  • You will not receive further SMS alerts after opting out
  • You can also manage SMS preferences within the Chickadee Health app

Getting Help

Consent and Purchase

Consent to receive SMS alerts is not a condition of purchase or use of Chickadee Health. You can use our service without enabling SMS notifications, though this may limit the effectiveness of family health monitoring.

Supported Carriers

SMS alerts are available for all major U.S. mobile carriers. If you experience issues receiving messages, please contact support.

User Responsibilities

When using Chickadee Health, you agree to:

Accurate Information

  • Provide accurate and current contact information for yourself and family members
  • Obtain consent from family members before adding their phone numbers to receive health alerts
  • Keep your account information up to date
  • Notify us immediately if you become aware of any unauthorized use of your account

Appropriate Use

  • Use the service only for its intended purpose of health monitoring and family communication
  • Not attempt to interfere with or disrupt the service
  • Not use the service for any illegal or unauthorized purpose
  • Comply with all applicable laws and regulations

HealthKit Permissions

  • Grant and maintain necessary Apple HealthKit permissions for our app to function
  • Understand that revoking HealthKit access will prevent the app from monitoring health data

Not Medical Advice - Limitation of Liability

Important Disclaimer

Chickadee Health is not a medical device and does not provide medical advice, diagnosis, or treatment. Our service is designed to assist families in monitoring general health patterns, but it is not a replacement for professional medical care.

What This Means

  • Always consult healthcare professionals: Never disregard professional medical advice or delay seeking it because of something you see (or don't see) in Chickadee Health
  • Not for emergencies: In case of emergency, call 911 or your local emergency services immediately. Do not rely on Chickadee Health alerts for emergency situations
  • No guarantees: We cannot guarantee that our alerts will detect all health concerns or prevent falls or other health incidents
  • Use at your own risk: You understand and agree that you use Chickadee Health at your own risk

Limitation of Liability

To the maximum extent permitted by law, Chickadee Health and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the service
  • Any bugs, viruses, or other harmful code that may be transmitted to or through our service
  • Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content

Termination Rights

Your Right to Terminate

You may stop using Chickadee Health at any time by:

  • Deleting the app from your device
  • Using the "Delete Account" feature in app settings
  • Contacting us at support@chickadee.family to request account deletion

Upon termination, your access to the service will end, and your data will be deleted according to our Privacy Policy.

Our Right to Terminate

We reserve the right to suspend or terminate your access to Chickadee Health if:

  • You violate these Terms & Conditions
  • You use the service in a way that could harm us, other users, or third parties
  • We are required to do so by law
  • We decide to discontinue the service (with reasonable notice to you)

Service Availability

While we strive to provide reliable service, we do not guarantee that Chickadee Health will be available at all times. The service may be interrupted for maintenance, updates, or due to circumstances beyond our control. We will make reasonable efforts to notify users of planned maintenance.

Intellectual Property

The Chickadee Health app, including its content, features, and functionality, is owned by Chickadee Health and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our service without our express written permission.

Privacy

Changes to These Terms
